By accessing or using TrakPitch at trakpitch.com ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. TrakPitch is operated by Sora Music Group ("we", "us", "our").
TrakPitch is a digital music promotion marketplace that connects music artists ("Artists") with playlist curators, blog editors, YouTube channels, and other music promoters ("Promoters"). Artists submit tracks and purchase promotion campaigns from Promoters. We facilitate the transaction, handle payment processing through Paddle (our payment processor), and manage payouts to Promoters.
You must be at least 18 years of age to use TrakPitch. By creating an account, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.
You must create an account to use the Platform. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.
Artists represent and warrant that they own or have obtained all necessary rights, licenses, and permissions for any music submitted to the Platform. You must not upload content that infringes any third-party intellectual property rights. Submitting a track for promotion does not transfer any ownership rights to TrakPitch or any Promoter. You are solely responsible for the content you upload.
Promoters agree to review all submissions within their accepted orders and deliver proof of promotion within 7 calendar days of receiving an order. Promoters must provide honest, good-faith consideration of each submission. Promoters may accept or decline to feature a track, but must provide feedback in either case. Failure to deliver within the 7-day window will result in an automatic refund to the Artist as described in our Refund Policy.
All prices are listed in USD. Payment processing is handled by Paddle, our merchant of record. Artists pay at the time of order placement. TrakPitch retains a platform margin on each transaction—this is how we operate and sustain the service. The remainder is paid out to the Promoter upon successful delivery and verification. Promoter payout rates are determined by their tier level. Payouts are processed after delivery is confirmed and any applicable review period has passed.
Refunds are governed by our Refund Policy. In summary: if a Promoter does not deliver proof of promotion within 7 days, the Artist receives an automatic full refund for that specific order item, processed back through Paddle to the original payment method.
The following activities are strictly prohibited on TrakPitch:
TrakPitch and its original content, features, and functionality are owned by Sora Music Group and protected by applicable intellectual property laws. Artists retain all rights to their music. Promoters retain all rights to their playlists, blogs, and editorial content. By using the Platform, you grant us a limited, non-exclusive license to display your content as necessary to operate the service.
TrakPitch does not guarantee any specific results from promotions. We do not guarantee increases in streams, followers, downloads, playlist placements, or any other metric. Promoters are paid for their time and consideration in reviewing your music. A Promoter declining to feature your track is a valid delivery outcome.
TrakPitch is provided "as is" and "as available" without warranties of any kind, express or implied. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total aggregate liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
TrakPitch reserves the right to suspend or terminate any account that violates these Terms, engages in prohibited conduct, or otherwise harms the Platform or its users. We may take action at our sole discretion, with or without prior notice. You may delete your account at any time by contacting support. Upon termination, any pending payouts will be processed according to our standard schedule, and any undelivered orders will be refunded to the Artist.
We may update these Terms at any time. We will notify users of material changes via email or a notice on the Platform. Continued use of TrakPitch after changes are posted constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws applicable to international digital services. Any disputes arising from these Terms or your use of the Platform shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in accordance with applicable rules. Each party bears its own costs unless otherwise determined by the arbitrator.
